Score One More for Constitution: Federal Judge Rules That Democrats’ Horrible ObamaCare Is Unconstitutional (video)

It’s a start. Actually, today’s ruling against ObamaCare by a federal judge in Florida presents a second victory for the majority of Americans who do not want the poorly written, trillion-dollar government-run health care program: In December, Judge Henry E. Hudson of Federal District Court in Richmond, Va., who was appointed by President George W. Bush, became the first to invalidate the insurance mandate. Two other federal judges named by President Bill Clinton, a Democrat, have upheld the law.

Judge Roger Vinson in Florida has ruled that the government-mandated, jobs-destroying, grotesquely expensive socialist health care plan is unconstitutional. The White House is sputtering, calling his ruling “judicial overreach.”

Hey, remember when conservatives objected to the Obamacare federal individual mandate on constitutional grounds and the liberal establishment laughed?

The word of the day: “Void.”

The constitutional clause of the day: The Commerce Clause.

And, moving right along, more info about those now 700-plus “Get Out of ObamaCare Free” cards (aka “socialist/Marxist health care” waivers, aka “political favors” paybacks, aka “Chicago cronyism screws regular Americans” waivers) that Team Obama has quietly given to major corporations and unions. The waivers at present exclude roughly 2 million people from having to fork over their own money to fund ObamaCare, but none of the “little people” in the US can get their own “waiver.” As of today, the number of waivers given to Obama’s BFFs, fat-cat unions, and major corporations is 733. That could change tomorrow. The House is launching an investigation.

Tom Blumer at NewsBusters has compiled a roundup and points out the hypocritical silence of much of the Obama-adoring left-wing media about the health care waivers. You don’t suppose they would be trying to BURY the information, trying to keep the public IN THE DARK about Dear Leader’s cronyism and hypocrisy, do ya?

It would appear that if it weren’t for the center-right blogosphere, Fox News, a few business dailies, a few conservative pundits, and talk radio, very few people would know about the hundreds of waivers granted by the Obama administration to companies, unions, not-for-profits, states, and other entities wishing to be spared the burdens of complying with Obamacare for at least another year.

The latest count as of last Wednesday’s Health and Human Services Department press release was 732, including four states: Massachusetts, Ohio, New Jersey, and Tennessee.

That the waiver situation is not more widely known is largely due to the fact that the establishment press has shown almost no interest in it.

The Associated Press has had five days to cover HHS’s latest release. It is news, as HHS’s release was, as far as I can tell, the first indication that “Over 500 waivers were granted in December.”

It should not be forgotten that the administration didn’t have to grant a single waiver if it didn’t feel like it. My recall of the law is that there isn’t even a requirement that HHS be consistent in its waiver-granting criteria. If repeal doesn’t occur soon and statist health care proponents seen an opening in the political climate, the waivers may stop a year or two before the January 1, 2014 full implementation date — either selectively or en masse.

Darned that dusty old Constitution that, according to WaPo hack Ezra Klein, no one can understand (translation: Americans are too stupid to comprehend it) because it’s waaay older than a century or sumptin’ like dat… and it’s always mucking up the statists’ power grabs.

Leftist Klein’s idiocy about the Constitution from December… this clown also thinks the Nazis had some pretty spiffy ideas.

  1. Even though i like a lot of the effort behind the health care reform, I must say that you can not force people to be insured.
    We do thing voluntary in this country and when we start making things like health insurance mandatory, we go down road
    that is unconstitutional.

    The repeal of the bill as a whole is clearly wrong. There are many good provisions such as the one saying that nobody can be denied health insurance based on a pre-existing condition and the repeal of this particular provision may cause a lot of problems to people diagnosed with serious medical conditions.
